White House AI Rules Would Force Model Makers to Allow "Any Lawful Use" in Federal Contracts
The Biden administration is preparing new guidelines that would require AI companies bidding on civilian government contracts to make their models available for "any lawful" purpose—a move that puts Washington on a collision course with Anthropic and other AI developers that have built their business models around restricting how customers can use their technology.
The draft rules, now circulating among federal agencies, represent the government's first major attempt to standardize AI procurement across civilian departments. For CFOs at companies selling AI services to federal clients, the implications are immediate: you may soon need to choose between maintaining usage restrictions and accessing billions in government contracts.
The timing is particularly awkward. Anthropic, maker of the Claude AI assistant, has spent the past year marketing itself as the "safe" alternative to OpenAI—emphasizing its constitutional AI approach and built-in guardrails. The company's pitch to enterprise customers, including finance departments, has centered on predictable, controlled deployments. Now the federal government is essentially saying: that's fine for private sector work, but if you want our money, you need to open it up.
The "any lawful use" language is doing a lot of work here. It doesn't mean the government wants AI for illegal purposes (obviously). What it means is that agencies don't want to be in the position of negotiating acceptable use policies contract-by-contract, or discovering mid-deployment that their vendor's terms of service prohibit some mundane government function. From the procurement officer's perspective, this makes perfect sense. From the AI company's perspective, it's asking them to abandon a core product differentiator.
Here's the thing everyone's missing: this isn't really about safety versus access. It's about liability and control. When Anthropic restricts usage, they're managing their own legal and reputational risk. When the government demands unrestricted access, they're saying "we'll manage that risk ourselves, thank you." The question is whether AI companies are willing to accept that deal—and whether their investors, who've priced in a certain risk profile, will let them.
For finance leaders, the practical question is simpler: if your company is building AI capabilities into government-facing products, do you have a plan B if your preferred vendor can't meet these requirements? Because "we're working on compliance" is not going to fly when the contract deadline hits.
The draft guidelines are still being refined, and there's no public timeline for finalization. But the direction is clear: the federal government wants to buy AI the way it buys other technology—with maximum flexibility and minimum vendor-imposed restrictions. Whether the AI industry adapts or walks away from federal contracts remains to be seen.
